{"id":898,"date":"2018-02-02T08:40:44","date_gmt":"2018-02-02T08:40:44","guid":{"rendered":""},"modified":"2019-07-23T15:41:53","modified_gmt":"2019-07-23T15:41:53","slug":"a-hierarchy-of-rights-protection-administrative-law-essay","status":"publish","type":"post","link":"https:\/\/www.lawteacher.net\/free-law-essays\/administrative-law\/a-hierarchy-of-rights-protection-administrative-law-essay.php","title":{"rendered":"A Hierarchy of Rights Protection"},"content":{"rendered":"<p><!--Content starts here--><\/p>\n<p>Human rights are all rights enshrine in the Universal Declaration of Human Rights (UDHR) &#8211; classified into two grand categories of civil-political&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn1\" name=\"bodyftn1\">1<\/a>]<\/span>&nbsp;and socio-economic rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn2\" name=\"bodyftn2\">2<\/a>]<\/span>&nbsp;The Vienna World Conference in 1993 recognized that \u2018all human rights are universal, indivisible, interdependent and interrelated.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn3\" name=\"bodyftn3\">3<\/a>]<\/span>&nbsp;This is further acknowledged by \u2018the most commendable\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn4\" name=\"bodyftn4\">4<\/a>]<\/span>&nbsp;South African Constitution which include a range of socio-economic and civil-political rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn5\" name=\"bodyftn5\">5<\/a>]<\/span>&nbsp;Besides, Justice Albie Sachs states, \u2018we do not want bread without freedom, nor do we do not want freedom bread; we want both.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn6\" name=\"bodyftn6\">6<\/a>]<\/span><\/p>\n<p>The principle of universality and indivisibility however is not fully embraced in international law, particularly in developed countries.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn7\" name=\"bodyftn7\">7<\/a>]<\/span>&nbsp;Furthermore, the relationship between civil-political and socio-economic rights has raised claims of hierarchical status.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn8\" name=\"bodyftn8\">8<\/a>]<\/span>&nbsp;This essay will explain the generations of human rights, then consider the desirability of a hierarchy of rights protection.<\/p>\n<h2>The \u2018Generations\u2019 of Human Rights<\/h2>\n<p>Human rights have been historically divided between \u2018generations\u2019. The first generation rights are fundamental freedom rights&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn9\" name=\"bodyftn9\">9<\/a>]<\/span>&nbsp;that serve to protect citizens from excesses of the State.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn10\" name=\"bodyftn10\">10<\/a>]<\/span>&nbsp;These are negative rights that encompassed the classic civil-political rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn11\" name=\"bodyftn11\">11<\/a>]<\/span>&nbsp;They emerged from American and the French Revolutions.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn12\" name=\"bodyftn12\">12<\/a>]<\/span><\/p>\n<p>Since the eighteenth and nineteenth century, living instruments of positive law and not only utopian concepts are concerned, recognized only first generation rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn13\" name=\"bodyftn13\">13<\/a>]<\/span>&nbsp;The 1776 Virginia Declaration of Rights contained rights to free elections, trial by jury, respect for property, and freedom of press, but omitted social rights related to welfare function of the state.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn14\" name=\"bodyftn14\">14<\/a>]<\/span>&nbsp;Similarly, the first twelve amendments of the US Constitution guarantees only physical security and a functioning judicial system.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn15\" name=\"bodyftn15\">15<\/a>]<\/span>&nbsp;The same ideas prevailed in France where the 1789 Declaration des Droits de l\u2019 Homme eet du Citoyen only create a functioning system of governance that does not burden the state with influential demands.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn16\" name=\"bodyftn16\">16<\/a>]<\/span><\/p>\n<p>The civil liberties have also monopolized the whole nineteenth century; the classic rights which became a necessary element of modern constitution were purely confined to classical freedoms.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn17\" name=\"bodyftn17\">17<\/a>]<\/span>&nbsp;Until the early twentieth century, a number of social and economic rights have been acknowledged at a constitutional level, particularly the 1917 Soviet Constitution and the German Weimar Constitution.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn18\" name=\"bodyftn18\">18<\/a>]<\/span>&nbsp;Likewise, the 1937 Irish Constitution interestingly included a provision on \u2018Directive principles of social policy\u2019.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn19\" name=\"bodyftn19\">19<\/a>]<\/span><\/p>\n<p>Despite these variations, first generation rights are fundamental to the constitution and have never been omitted. It provides a conceptual platform to identify other rights and distinguish two distinct thematic categories.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn20\" name=\"bodyftn20\">20<\/a>]<\/span>&nbsp;Socio-economic rights are not included but classified as second generation rights.<\/p>\n<p>The second generation rights emerged under Bismarck, a German authoritarian leader who fought for welfare rights of German workers in the late nineteenth century.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn21\" name=\"bodyftn21\">21<\/a>]<\/span>&nbsp;They are a child of twentieth century and concern social welfare of persons.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn22\" name=\"bodyftn22\">22<\/a>]<\/span>&nbsp;These rights appeared quite late on the stage of constitutional developments and have frightened and fascinated constitution making bodies.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn23\" name=\"bodyftn23\">23<\/a>]<\/span><\/p>\n<p>Ireland was reluctant to commit itself to social welfare benefits at constitutional level after the end of World War II as the caution in handling human rights matter in general by France.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn24\" name=\"bodyftn24\">24<\/a>]<\/span>&nbsp;In France, these rights were introduced by a clause which characterized them as political, economic and social principles.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn25\" name=\"bodyftn25\">25<\/a>]<\/span>&nbsp;While Germany had restrict its post-war constitution to a general clause declaring itself as a \u2018social state\u2019 after a difficult experience under the Weimar Constitution to effectively handle social and economic rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn26\" name=\"bodyftn26\">26<\/a>]<\/span>&nbsp;Portugal and Spain have included second generations in their declaration an extensive lists of human rights; they were able to shift from dictatorships to democratic regimes.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn27\" name=\"bodyftn27\">27<\/a>]<\/span>&nbsp;Such recognitions and growing awareness have drew strong support from the UDHR after the World War II and are indeed part of the language of international human rights since then.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn28\" name=\"bodyftn28\">28<\/a>]<\/span><\/p>\n<p>The historical development of the both rights into generations caused rights to be treated differently. As Justice Albie contends, this structure will imply that second generation is less important than first.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn29\" name=\"bodyftn29\">29<\/a>]<\/span>&nbsp;It tends to illustrate a priority of rights thus establishing a hierarchy of rights protection. In 1966, the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) were adopted simultaneously. Commentators in distinguishing these two have often put the legal enforceability of the socio-economic rights in doubt.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn30\" name=\"bodyftn30\">30<\/a>]<\/span><\/p>\n<p>There is no consensus as to the appropriate means to ensure socio-economic rights. Indeed, there has been significantly less attention to develop the content and enforcement mechanisms of socio-economic rights compared to civil-political rights. Professor Paul Hunt&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn31\" name=\"bodyftn31\">31<\/a>]<\/span>&nbsp;contends while civil-political rights were privileged; socio-economic rights were the poor relations in the international human rights family for many years and were neglected and marginalized.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn32\" name=\"bodyftn32\">32<\/a>]<\/span>&nbsp;The 1993 Vienna Conference apparently was aware of this unequal treatment, thus acknowledged that both rights were legally reflected in the principle of indivisibility.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn33\" name=\"bodyftn33\">33<\/a>]<\/span>&nbsp;They are of equal importance.<\/p>\n<p>Besides the generations\u2019 classifications, these gaps are one of the reasons to different treatment of rights. They came about by the prominence of western countries to civil-political rights in the cold war divide.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn34\" name=\"bodyftn34\">34<\/a>]<\/span>&nbsp;The justiciability of socio-economic rights have subsequently been extensively ignored and neglected.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn35\" name=\"bodyftn35\">35<\/a>]<\/span>&nbsp;Despite the principle of indivisibility declared by the Vienna Conference, bridging the gaps between civil-political and socio-economic rights is perhaps the best proof to their equal importance and symbiotic relationship.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn36\" name=\"bodyftn36\">36<\/a>]<\/span><\/p>\n<h2>The Indivisibility of Human Rights<\/h2>\n<p>The generations\u2019 classifications are now seen as inaccurate. The principle of indivisibility is an important aspect of human rights that many international instruments have specifically refers to.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn37\" name=\"bodyftn37\">37<\/a>]<\/span>&nbsp;Similarly, it is embraced by numerous scholars and advocates.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn38\" name=\"bodyftn38\">38<\/a>]<\/span>&nbsp;However, many have ascribed it in an entirely self-evident manner. It is questionable for the UN and others that have declared the matter settled. Civil-political rights are often seen as higher in the hierarchy of protection than socio-economic rights.<\/p>\n<p>Macklem observes that \u2018social rights often suffer from a painful lack of precision with respect to the nature and extent of obligations that attach to the state party.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn39\" name=\"bodyftn39\">39<\/a>]<\/span>&nbsp;This indicates that socio-economic rights are imprecise hence doubting the legal enforceability.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn40\" name=\"bodyftn40\">40<\/a>]<\/span>&nbsp;This argument is however, inconsistent with Pieterse; he remarks that courts are good at statutory interpretation and they should do the same in construing how the branches of state can cooperate to enforce socio-economic rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn41\" name=\"bodyftn41\">41<\/a>]<\/span>&nbsp;Likewise, Blichitz assumes judicial responsibility to define and clarify the extent of obligations imposed upon the government.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn42\" name=\"bodyftn42\">42<\/a>]<\/span>&nbsp;It is however argued such judicial enforcement of socio-economic rights will threaten the legislative powers to make law in the public interest.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn43\" name=\"bodyftn43\">43<\/a>]<\/span>&nbsp;It is in fact difficult to maintain an inflexible distinction between socio-economic and civil-political rights which have little controversy over judicial enforcement.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn44\" name=\"bodyftn44\">44<\/a>]<\/span><\/p>\n<p>South Africa is perhaps the \u2018centre of legal developments of this area.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn45\" name=\"bodyftn45\">45<\/a>]<\/span>&nbsp;Its Constitution embraces greater transparency, participatory democracy, protection of cultural values and socio-economic equality.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn46\" name=\"bodyftn46\">46<\/a>]<\/span>&nbsp;It protects some socio-economic rights and the courts have the powers to scrutinise state compliance to the obligations to such rights. Furthermore, the preamble of the African Charter on Human and Peoples\u2019 Rights strikes unequivocally stating \u2018that the satisfaction of socio-economic rights is a guarantee for the enjoyment of civil-political rights.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn47\" name=\"bodyftn47\">47<\/a>]<\/span>&nbsp;The implementation obligation of states under the Charter arises immediately, not qualified by considerations of \u2018available resources.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn48\" name=\"bodyftn48\">48<\/a>]<\/span><\/p>\n<p>Besides, the South African Constitution Court has taken a standard of reasonableness to measure government policy and legislation. Cass Sustein observes this approach as an administrative law model and praises its effectiveness in making appropriate demands on government, \u2018without displacing democratic judgments about how to set priorities\u2019.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn49\" name=\"bodyftn49\">49<\/a>]<\/span>&nbsp;It is also held in Grootboom&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn50\" name=\"bodyftn50\">50<\/a>]<\/span>&nbsp;that<\/p>\n<p>\u2018\u2026our constitution entrenches both civil and social rights that in our bill of rights are interrelated and mutually supporting. There cannot be doubt that human dignity, freedom and equality, the foundational values of our society are denied those who have no food, clothing or shelter.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn51\" name=\"bodyftn51\">51<\/a>]<\/span><\/p>\n<p>These are recognised to be a notable achievement of South Africa Constitution, a hierarchy of rights protection can hardly be seen.<\/p>\n<p>It is nonetheless debatable that socio-economic rights should have been given constitutional status, hence the controversies continue. Following the development of South African jurisprudence and the recognition of such rights in other jurisdiction, legal practitioners have always strive to achieve a effective legal means of protecting and enforcing these rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn52\" name=\"bodyftn52\">52<\/a>]<\/span>&nbsp;The South African model has the potential if developed more effectively to offer greater protection to socio-economic rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn53\" name=\"bodyftn53\">53<\/a>]<\/span>&nbsp;The approach might be a valuable guidance for jurisdictions like the UK with no constitutional socio-economic rights.<\/p>\n<p>Mary Robinson is however puzzled, \u2018If the principle of indivisibility of human rights is not fully embraced in developed countries, how effective can efforts be to insist that economic globalisation should be shaped by the international human rights law.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn54\" name=\"bodyftn54\">54<\/a>]<\/span>&nbsp;In considering a periodic report from the UK, the UN Committee on Economic, Social and Cultural Rights asserts that the government representatives gave the impression that socio-rights were not of the same nature or priority as civil-political rights incorporated under the Human Rights Act 1998.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn55\" name=\"bodyftn55\">55<\/a>]<\/span>&nbsp;Moreover, the UK considers the ICESCR subservient to the UN Charter.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn56\" name=\"bodyftn56\">56<\/a>]<\/span>&nbsp;Even so, UK courts are engaging in the protection of socio-economic legislative rights and interests under judicial review decisions by the Human Rights Act 1998.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn57\" name=\"bodyftn57\">57<\/a>]<\/span>&nbsp;.<\/p>\n<p>The indivisibility of human rights is indeed clear in the UK even though there is no explicit recognition of socio-economic rights. In Ex parte Joint Council for the Welfare of Immigration&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn58\" name=\"bodyftn58\">58<\/a>]<\/span>&nbsp;, Simon Brown LJ held that to deny the asylum seekers benefits that they could not work, would create \u2018\u2026 a life so destitute that\u2026 no civilized nation could tolerate.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn59\" name=\"bodyftn59\">59<\/a>]<\/span>&nbsp;Thus, it is largely agreed that socio-economic rights is one of the essential element to \u2018right to life\u2019.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn60\" name=\"bodyftn60\">60<\/a>]<\/span>&nbsp;Ewing further confirms that social rights are \u2018logically prior\u2019 to exercising civil-political rights&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn61\" name=\"bodyftn61\">61<\/a>]<\/span>&nbsp;and thus they are not a distinct categories of rights.<\/p>\n<p>UK human rights awareness develops after the incorporation of European Convention of Human Rights. Francesca Klug however contended that \u2018the incorporation has not proved as dramatic or unsettling for the British way of life as some predicted\u2019.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn62\" name=\"bodyftn62\">62<\/a>]<\/span>&nbsp;Furthermore, Lord Hoffman in Mathews v Ministry of Defence&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn63\" name=\"bodyftn63\">63<\/a>]<\/span>&nbsp;submits that \u2018\u2026there is no trace of economic rights in the Convention\u2026without which many of the other rights would be a mockery.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn64\" name=\"bodyftn64\">64<\/a>]<\/span>&nbsp;Mary Robinson might be correct when he highlights the possible problem that \u2018emphasis on the European Convention and its jurisprudence has prevented the other commitments of the government on the parallel ICESCR.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn65\" name=\"bodyftn65\">65<\/a>]<\/span>&nbsp;Likewise, socio-economic rights are non-justiciable principle based on Ireland\u2019s constitutional language.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn66\" name=\"bodyftn66\">66<\/a>]<\/span><\/p>\n<p>ICESCR has not been ratified in the US. The US administrations have consistently rejected the socio-economic rights notwithstanding they were drafted into the UDHR from their proposals and Eleanor Roosevelt played a notable role in the process.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn67\" name=\"bodyftn67\">67<\/a>]<\/span>&nbsp;Although US have completely rejected social and economic benefits as constitutional entitlements; such benefits are nevertheless provided without hesitations at the level of ordinary legislation.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn68\" name=\"bodyftn68\">68<\/a>]<\/span><\/p>\n<p>The issues usually arise with the enforceability methods. With the increasing numbers of jurisprudence that consider socio-economic rights, they are no longer obscure than civil political rights.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn69\" name=\"bodyftn69\">69<\/a>]<\/span>&nbsp;Sandra Liebenberg concludes it well,<\/p>\n<p>\u2018it is through recourse to the conventions of constitutional interpretation and their application to the facts of different cases that the specific content and scope of a right emerges with greater clarity&#8230; the content of many socio-economic rights is less well-defined\u2026 is more a reflection of their exclusion from processes of adjudication than of their inherent nature.\u2019&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn70\" name=\"bodyftn70\">70<\/a>]<\/span><\/p>\n<p>Every human right imposes positive and negative obligations.
