{"id":636,"date":"2018-03-07T09:27:02","date_gmt":"2018-03-07T09:27:02","guid":{"rendered":""},"modified":"2020-06-01T10:58:45","modified_gmt":"2020-06-01T10:58:45","slug":"amendments","status":"publish","type":"post","link":"https:\/\/www.lawteacher.net\/law-help\/lpc\/amendments.php","title":{"rendered":"Amendments to Statements of Case | LPC Help"},"content":{"rendered":"<p><strong>11.6 Amendments to Statements of Case<\/strong><\/p>\n<p>CPR Part 17 allows any party to amend their <a href=\"statements-of-case.php\">Statements of Case<\/a> before it has been served.<\/p>\n<p>Once a <a href=\"statements-of-case.php\">Statements of Case<\/a> has been served, however, a party can only amend it if they first obtain either the written consent of all the other parties or get the permission of the Court.<\/p>\n<p>An application to amend a <a href=\"statements-of-case.php\">Statements of Case<\/a> by removing, adding or substituting once it has been served must, be made in accordance with CPR Rule 19.4.<\/p>\n<p>This states that nobody may be added or substituted as a claimant unless:<\/p>\n<ul class=\"list-unstyled\">\n<li>(a) he has given his consent in writing; and<\/li>\n<li>(b) that consent has been filed with the Court. (4A)<\/li>\n<\/ul>\n<p>The Commissioners for HM Revenue and Customs may be added as a party to proceedings only if they consent in writing.<\/p>\n<p>CPR19.5 requires that an order for the removal, addition or substitution of a party to must be served on all other parties as well as anyone else affected by the order.<\/p>\n<p>Under CPR19.6, if the Court makes an order for the removal, addition or substitution of a party, it may also give consequential directions regarding:<\/p>\n<p>(a) filing and serving the claim form on any new defendant;<\/p>\n<p>(b) serving relevant documents on the new party; and<\/p>\n<p>(c) the management of the proceedings.<\/p>\n<h3>Also in this section:<\/h3>\n<div class=\"list-group mb-3\">\n<p>    <a class=\"list-group-item d-flex justify-content-between align-items-center\" href=\"drafting-menu.php\">11.
