{"id":6089,"date":"2018-10-12T12:38:31","date_gmt":"2018-10-12T12:38:31","guid":{"rendered":""},"modified":"2019-06-17T12:47:22","modified_gmt":"2019-06-17T12:47:22","slug":"first-national-v-hegerty","status":"publish","type":"post","link":"https:\/\/www.lawteacher.net\/cases\/first-national-v-hegerty.php","title":{"rendered":"First National Securities Ltd v Hegerty"},"content":{"rendered":"<p><strong>First National Securities Ltd v Hegerty [1985] QB 850<\/strong><\/p>\n<p>Mortgage \u2013 Forged Signature of Wife \u2013 Joint Tenants \u2013 Severance<\/p>\n<h3 id=\"facts\">Facts<\/h3>\n<p>A husband and wife were joint tenants of the matrimonial home.\u00a0 Unknown to the wife, the husband forged her signature on mortgage applications with First National Securities.\u00a0 The mortgage application was successful.\u00a0 The husband then took the money and fled abroad.\u00a0 The bank sought a charging order over the husband\u2019s equitable share of the property.<\/p>\n<h3 id=\"issues\">Issues<\/h3>\n<p>Whether or not the charging order could be granted over the husbands, but not the wife\u2019s equitable interest in the property.\u00a0 Whether or not the application for a mortgage on behalf of the husband was an act consistent with the husband acting upon his own interest and so capable of severing the joint tenancy.<\/p>\n<h3 id=\"decision\">Decision\/Outcome<\/h3>\n<p>The application for the mortgage alone severed the joint tenancy as it was held to be an act which was inconsistent with the concept of a joint tenancy.\u00a0 This could be seen as an act of an individual acting upon their own share, and so a cause for severance of the joint tenancy as set down in <strong>Williams v Hensman (1861) 70 E.R. 862<\/strong>.\u00a0 The fraudulent legal charge could be effective against the husband\u2019s interest in the property, but not against the wife\u2019s interest.\u00a0 The lender was therefore entitled to a legal charge over the property which could be enforced by way of an order for an application for sale, then under <strong>s30 Law of Property Act 1925<\/strong>, and which would now fall under <strong>s14 Trusts of Land and Appointment of Trustees Act 1996<\/strong><strong>(TOLATA)<\/strong>.\u00a0 The hardship caused to the wife in this case was not sufficient to prevent a charging order being created.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A husband and wife were joint tenants of the matrimonial home.
