9.2 Statement of Value<\/strong><\/p>\n

Under CPR 16.3, if a claimant is making a claim for money, they must state the following in the claim form:<\/p>\n

(a) the amount of money which he is claiming;<\/p>\n

(b) that he expects to recover –<\/p>\n

(i) not more than \u00a35,000<\/p>\n

(ii) more than \u00a35,000 but not more than \u00a315,000; or<\/p>\n

(iii) more than \u00a315,000; or<\/p>\n

(c) that he cannot say how much he expects to recover.<\/p>\n

If the claim is for personal injury, under CPR 16.3(3), the Claimant must also state in the claim form whether the amount expected for pain, suffering and loss of amenity is:<\/p>\n

(a) not more than \u00a31,000; or<\/p>\n

(b) more than \u00a31,000.<\/p>\n

Under CPR 16.4(4), if a tenant of residential premises is seeking an order requiring the landlord to carry out repairs or other work to the premises, the Claimant must also state in the claim form:<\/p>\n

(a) whether the estimated costs of those repairs or other work is:<\/p>\n

(i) not more than \u00a31,000; or<\/p>\n

(ii) more than \u00a31,000; and<\/p>\n

(b) whether the financial value of any other claim for damages is:<\/p>\n

(i) not more than \u00a31,000; or<\/p>\n

(ii) more than \u00a31,000.<\/p>\n

Under 16.4(5) if the claim form is to be issued in the High Court it must:<\/p>\n

(a) state that the Claimant expects to recover more than \u00a315,000;<\/p>\n

(b) state that some other enactment provides that the claim may be commenced only in the High Court and specify that enactment;<\/p>\n

(c) if the claim is a claim for personal injuries state that the Claimant expects to recover \u00a350,000 or more; or<\/p>\n

(d) state that the claim is to be in one of the specialist High Court lists and state which list.<\/p>\n

In terms of working out the amount that the Claimant expects to recover, the following should be ignored:<\/p>\n

(a)<\/p>\n

(i) interest;<\/p>\n

(ii) costs;<\/p>\n

(b) that the Court may make a finding of contributory negligence against him;<\/p>\n

(c) that the Defendant may make a counterclaim or that the defence may include a set-off; or<\/p>\n

(d) that the Defendant may be liable to pay an amount of money which the Court awards to the Claimant to the Secretary of State for Social Security under section 6 of the Social Security (Recovery of Benefits) Act 1997 1.<\/p>\n

Under CPR 16.4(7) the statement of value in the claim form does not prevent the Court from giving judgement for any amount to which the Claimant is entitled.<\/p>\n
