An accident occurred on the road, which was caused by the driver\u2019s drunkness and the plaintiff was injured. She sued the driver\u2019s personal representative \u2013 the defendant, for damages. In the action against him, the personal representative raised the defence of <em>volenti non fit injuria<\/em>.<\/p>\n<h3 id=\"issues\">Issues<\/h3>\n<p>Can the defence of <em>volenti non fit injuria<\/em> be used in order to preclude from remedy a person who has voluntarily accepted the risk which arises from a driver who is driving a car under the influence of alcohol?<\/p>\n<h3 id=\"decision\">Decision \/ Outcome<\/h3>\n<p>The decision was in favour of the plaintiff.<\/p>\n<p>(1) Applying <a href=\"https:\/\/www.lawteacher.net\/cases\/smith-v-baker.php\"><em>Smith v Baker &#038;
