{"id":4290,"date":"2018-02-02T08:40:46","date_gmt":"2018-02-02T08:40:46","guid":{"rendered":""},"modified":"2019-08-12T12:43:37","modified_gmt":"2019-08-12T12:43:37","slug":"two-jurisdictions-of-law-and-equity-law-essays","status":"publish","type":"post","link":"https:\/\/www.lawteacher.net\/free-law-essays\/equity-law\/two-jurisdictions-of-law-and-equity-law-essays.php","title":{"rendered":"Two Jurisdictions of Law and Equity"},"content":{"rendered":"<p><!--Content starts here!--><\/p>\n<p>The debate as to whether the two jurisdictions of law and equity have been fused stems from the enactment of the Judicature Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn1\" name=\"bodyftn1\">1<\/a>]<\/span>&nbsp;which amalgamated the Chancery and Law courts into one Supreme Court.<\/p>\n<p>The enactment itself demonstrates the two jurisdictions were not fused&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn2\" name=\"bodyftn2\">2<\/a>]<\/span>&nbsp;but rather the vesting in one tribunal of the administration of the jurisdictions in all actions.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn3\" name=\"bodyftn3\">3<\/a>]<\/span>&nbsp;Traditionally the administration of equity was dealt with in a separate court&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn4\" name=\"bodyftn4\">4<\/a>]<\/span>&nbsp;to that of common law.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn5\" name=\"bodyftn5\">5<\/a>]<\/span>&nbsp;The law was bound by strict rules of precedents&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn6\" name=\"bodyftn6\">6<\/a>]<\/span>&nbsp;which created injustices and hardship&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn7\" name=\"bodyftn7\">7<\/a>]<\/span>&nbsp;whereas equity\u2019s principles developed according to the Chancellor\u2019s discretion&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn8\" name=\"bodyftn8\">8<\/a>]<\/span>&nbsp;which did not replace the law&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn9\" name=\"bodyftn9\">9<\/a>]<\/span>&nbsp;but assisted it&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn10\" name=\"bodyftn10\">10<\/a>]<\/span>&nbsp;by mitigating the rigors of strict law.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn11\" name=\"bodyftn11\">11<\/a>]<\/span>&nbsp;The Judicature Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn12\" name=\"bodyftn12\">12<\/a>]<\/span>&nbsp;recognised the two sets of principles and reaffirmed the ruling by King James I; where cases of equity and law conflicted, equity was to prevail.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn13\" name=\"bodyftn13\">13<\/a>]<\/span>&nbsp;Equity was and still is a &#8216;gloss&#8217;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn14\" name=\"bodyftn14\">14<\/a>]<\/span>&nbsp;on common law because it acknowledges the law&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn15\" name=\"bodyftn15\">15<\/a>]<\/span>&nbsp;and supplements it where necessary,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn16\" name=\"bodyftn16\">16<\/a>]<\/span>&nbsp;illustrating they do not mingle.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn17\" name=\"bodyftn17\">17<\/a>]<\/span>&nbsp;The Supreme Court Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn18\" name=\"bodyftn18\">18<\/a>]<\/span>&nbsp;also implies equity and law remain separate bodies by \u201cre-enacting the provisions of the Judicature Act.&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn19\" name=\"bodyftn19\">19<\/a>]<\/span><\/p>\n<p>The evolvement of equity gave persons equitable interests as well as legal interests, especially with regards to property&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn20\" name=\"bodyftn20\">20<\/a>]<\/span>&nbsp;and trusts.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn21\" name=\"bodyftn21\">21<\/a>]<\/span>&nbsp;Legal interests are a right whereas equitable interests are dependent on the distinct set of discretionary rules known as maxims. The maxims are not specific rules of law, but guidelines to be borne in mind when reaching a decision&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn22\" name=\"bodyftn22\">22<\/a>]<\/span>&nbsp;which supports the argument in favour of no fusion. The maxim, equity looks to the intent rather than the form&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn23\" name=\"bodyftn23\">23<\/a>]<\/span>&nbsp;concentrates on what the parties impliedly&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn24\" name=\"bodyftn24\">24<\/a>]<\/span>&nbsp;or expressly&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn25\" name=\"bodyftn25\">25<\/a>]<\/span>&nbsp;intended regardless of the common law legal formalities; coinciding with the maxims: equity follows the law,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn26\" name=\"bodyftn26\">26<\/a>]<\/span>&nbsp;looks on that as done which ought to be done&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn27\" name=\"bodyftn27\">27<\/a>]<\/span>&nbsp;and will not suffer a wrong to be without a remedy&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn28\" name=\"bodyftn28\">28<\/a>]<\/span>&nbsp;which all corroborate anti-fusion. Equitable maxims only apply to persons seeking equitable relief; therefore equitable remedies cannot be used as a defence,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn29\" name=\"bodyftn29\">29<\/a>]<\/span>&nbsp;highlighting distinctions. Common law\u2019s only remedy was ordering a defendant to pay a sum of money to the claimant by way of compensation referred to as damages. To solve this problem, equity introduced new remedies, the most notable being: an injunction, which orders a defendant to do or not do something;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn30\" name=\"bodyftn30\">30<\/a>]<\/span>&nbsp;specific performance, which compels a party to fulfil a previous agreement&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn31\" name=\"bodyftn31\">31<\/a>]<\/span>&nbsp;and promissory estoppel; which prevents a person from going back on a promise which was intended to create legal relations, despite lack of consideration.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn32\" name=\"bodyftn32\">32<\/a>]<\/span>&nbsp;These equitable remedies met the required needs of a wronged party where damages were inappropriate.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn33\" name=\"bodyftn33\">33<\/a>]<\/span>&nbsp;Equitable remedies, unlike damages, cannot be claimed as a right; they are completely discretionary and will not be granted if damages are sufficient&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn34\" name=\"bodyftn34\">34<\/a>]<\/span>&nbsp;or hardship bestows the defendant.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn35\" name=\"bodyftn35\">35<\/a>]<\/span>&nbsp;Equity also acts in personam;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn36\" name=\"bodyftn36\">36<\/a>]<\/span>&nbsp;meaning it operates on the conscience&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn37\" name=\"bodyftn37\">37<\/a>]<\/span>&nbsp;of the party against whom the relief is sought, as opposed to common law operating in rem;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn38\" name=\"bodyftn38\">38<\/a>]<\/span>&nbsp;concluding the subject matter of the dispute need not be within the jurisdiction&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn39\" name=\"bodyftn39\">39<\/a>]<\/span>&nbsp;only the person; hence two separate systems.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn40\" name=\"bodyftn40\">40<\/a>]<\/span><\/p>\n<p>Prior to the amalgamation of the courts, persons seeking both equitable and common law remedies were obliged to take two separation actions. The problem was partially solved by the Chancery Amendment Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn41\" name=\"bodyftn41\">41<\/a>]<\/span>&nbsp;which enabled the Chancery to award damages in lieu of an equitable remedy&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn42\" name=\"bodyftn42\">42<\/a>]<\/span>&nbsp;and the Common Law Procedure Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn43\" name=\"bodyftn43\">43<\/a>]<\/span>&nbsp;gave a limited amount of power to the Law Courts to issue equitable remedies. In light of this, and the courts merging it became apparent \u201cjudges had the tools to break down historical barriers and mindsets&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn44\" name=\"bodyftn44\">44<\/a>]<\/span>&nbsp;because the Judicature Act&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn45\" name=\"bodyftn45\">45<\/a>]<\/span>&nbsp;itself also implied fusion had occurred;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn46\" name=\"bodyftn46\">46<\/a>]<\/span>&nbsp;culminating towards pro-fusion.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn47\" name=\"bodyftn47\">47<\/a>]<\/span>&nbsp;Respective judges therefore concluded various interpretations of the enactment&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn48\" name=\"bodyftn48\">48<\/a>]<\/span>&nbsp;and these conflicting views are the upshot of different approaches taken. Some judges are of the opinion there is no distinction between law and equity,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn49\" name=\"bodyftn49\">49<\/a>]<\/span>&nbsp;whilst others steadfastly to the contrary.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn50\" name=\"bodyftn50\">50<\/a>]<\/span>&nbsp;The debate was heightened when damages were awarded for an equitable claim of breach of confidence&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn51\" name=\"bodyftn51\">51<\/a>]<\/span>&nbsp;because the CAA did not give the Chancery power to award common law damages&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn52\" name=\"bodyftn52\">52<\/a>]<\/span>&nbsp;only equitable compensation.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn53\" name=\"bodyftn53\">53<\/a>]<\/span>&nbsp;However, the previous misinterpretation of the CAA&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn54\" name=\"bodyftn54\">54<\/a>]<\/span>&nbsp;remains,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn55\" name=\"bodyftn55\">55<\/a>]<\/span>&nbsp;thus strengthening the fusion fallacy.<\/p>\n<p>Another example of pro-fusion is Tinsley v Milligan&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn56\" name=\"bodyftn56\">56<\/a>]<\/span>&nbsp;which concerned rights to property and the issue of illegality. At common law, persons could acquire rights to property under illegal transactions if they could make their claim without relying on the illegality.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn57\" name=\"bodyftn57\">57<\/a>]<\/span>&nbsp;Equity however would not tolerate this.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn58\" name=\"bodyftn58\">58<\/a>]<\/span>&nbsp;It either barred persons&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn59\" name=\"bodyftn59\">59<\/a>]<\/span>&nbsp;or prevented an equitable remedy&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn60\" name=\"bodyftn60\">60<\/a>]<\/span>&nbsp;provided the impropriety was specific to the claim&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn61\" name=\"bodyftn61\">61<\/a>]<\/span>&nbsp;and referred to past conduct only&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn62\" name=\"bodyftn62\">62<\/a>]<\/span>&nbsp;relying on the \u201cunclean hands&#8221; maxim that; \u201cno court will lend its aid to a man who founds his cause of action upon an illegal act&#8221;.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn63\" name=\"bodyftn63\">63<\/a>]<\/span>&nbsp;In Tinsley v Milligan,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn64\" name=\"bodyftn64\">64<\/a>]<\/span>&nbsp;notwithstanding the illegality issue, the court held the defendant had a \u201cright in law to assert her equitable ownership&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn65\" name=\"bodyftn65\">65<\/a>]<\/span>&nbsp;based on a resulting trust;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn66\" name=\"bodyftn66\">66<\/a>]<\/span>&nbsp;confirming \u201cthe two strands of authority were moulded&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn67\" name=\"bodyftn67\">67<\/a>]<\/span>&nbsp;and \u201cshould be viewed as a consistent whole as there was no logic in making a distinction.&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn68\" name=\"bodyftn68\">68<\/a>]<\/span>&nbsp;This decision was viewed as merging the \u201cunclean hands&#8221; maxim&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn69\" name=\"bodyftn69\">69<\/a>]<\/span>&nbsp;into the common law rule.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn70\" name=\"bodyftn70\">70<\/a>]<\/span>&nbsp;In contrast, those opposing this view actually agreed with the outcome but on the basis that the resulting trust could not be rebutted&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn71\" name=\"bodyftn71\">71<\/a>]<\/span>&nbsp;because the impropriety occurred after the creation of the trust. Indicating equity relied on the intention rather than the form,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn72\" name=\"bodyftn72\">72<\/a>]<\/span>&nbsp;safeguarding the \u201cunclean hands&#8221; maxim;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn73\" name=\"bodyftn73\">73<\/a>]<\/span>&nbsp;and reinforcing the two substantive systems of law and equity are not fused.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn74\" name=\"bodyftn74\">74<\/a>]<\/span>&nbsp;Nonetheless, the opinion that this equitable principle has become fused with the common law rule has been further substantiated&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn75\" name=\"bodyftn75\">75<\/a>]<\/span>&nbsp;enabling the remedy available both at common law and equity. As a consequence some academic writers believe \u201cequitable doctrines should now take their proper place as part of a unified system of judge made law alongside and integrated with common law and statute&#8221;;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn76\" name=\"bodyftn76\">76<\/a>]<\/span>&nbsp;whilst others suggest its time they were fully integrated because it is not only equity that exercises discretion.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn77\" name=\"bodyftn77\">77<\/a>]<\/span><\/p>\n<p>It is fair to say that common law also exercises a degree of discretion&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn78\" name=\"bodyftn78\">78<\/a>]<\/span>&nbsp;by applying the \u201creasonable foreseeability&#8221; test.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn79\" name=\"bodyftn79\">79<\/a>]<\/span>&nbsp;This indicates that the law has \u201ccaught up with equity and it is therefore not possible to contrast the two&#8221;.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn80\" name=\"bodyftn80\">80<\/a>]<\/span>&nbsp;However the discretion applied in law is an&#8221; objective test&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn81\" name=\"bodyftn81\">81<\/a>]<\/span>&nbsp;as opposed to the \u201csubjective test&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn82\" name=\"bodyftn82\">82<\/a>]<\/span>&nbsp;in equity which applies the equitable maxims. The variance in the discretions, preserve that law and equity remain completely and separately unconnected.<\/p>\n<p>Equity\u2019s greatest contribution to law is the \u201ctrust&#8221; formerly known as the \u201cuse&#8221;.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn83\" name=\"bodyftn83\">83<\/a>]<\/span>&nbsp;A trust occurs when a person&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn84\" name=\"bodyftn84\">84<\/a>]<\/span>&nbsp;holds property for the use of another.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn85\" name=\"bodyftn85\">85<\/a>]<\/span>&nbsp;It created beneficial interests in land&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn86\" name=\"bodyftn86\">86<\/a>]<\/span>&nbsp;which did not exist in common law&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn87\" name=\"bodyftn87\">87<\/a>]<\/span>&nbsp;by splitting rights into legal and equitable interests, which is a prime example of anti-fusion. Legal interests were only recognised and enforced by law providing the appropriate formalities were applied;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn88\" name=\"bodyftn88\">88<\/a>]<\/span>&nbsp;whereas equity was able to establish new equitable propriety rights in the absence of formalities&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn89\" name=\"bodyftn89\">89<\/a>]<\/span>&nbsp;because it concentrated on the substance of the transaction&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn90\" name=\"bodyftn90\">90<\/a>]<\/span>&nbsp;as opposed to the form.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn91\" name=\"bodyftn91\">91<\/a>]<\/span>&nbsp;Even though trusts were born from equity, they too are now the subject of legal formalities.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn92\" name=\"bodyftn92\">92<\/a>]<\/span>&nbsp;Any shortcomings in the formalities, the trust will cease to exist at common law.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn93\" name=\"bodyftn93\">93<\/a>]<\/span>&nbsp;Nonetheless, and in comparison to the law; equity can imply a trust&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn94\" name=\"bodyftn94\">94<\/a>]<\/span>&nbsp;based on the presumption of the true intentions of the parties,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn95\" name=\"bodyftn95\">95<\/a>]<\/span>&nbsp;or infer a common intention from the general conduct of the parties;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn96\" name=\"bodyftn96\">96<\/a>]<\/span>&nbsp;exemplifying law and equity are indeed detached. If fusion had occurred, trusts would be ineffective as they are the tools of ensuring trustees hold property for beneficiaries,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn97\" name=\"bodyftn97\">97<\/a>]<\/span>&nbsp;which the common law refuses to acknowledge.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn98\" name=\"bodyftn98\">98<\/a>]<\/span>&nbsp;In essence trustees would be the absolute owner generating injustices and hardship; the very reason why equity came into existence. The trust is \u201cequity\u2019s most significant feature and is primarily about money and the preservation of wealth;&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn99\" name=\"bodyftn99\">99<\/a>]<\/span>&nbsp;which was primarily land. As society evolved so too did the trust, to incorporate the preservation of wealth in any form; which has had a great influence in the development of mortgages.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn100\" name=\"bodyftn100\">100<\/a>]<\/span><\/p>\n<p>Common law treated mortgages like contracts; hence any failure to discharge the loan by a specified date would result in the mortgaged property being forfeited to the lender under the common law \u201cdoctrine of forfeiture&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn101\" name=\"bodyftn101\">101<\/a>]<\/span>&nbsp;despite the borrower still being liable for the debt. The doctrine \u201cequity of redemption&#8221; softened the harshness of the law by restricting the use of forfeiture and limiting the lender&#8217;s rights to the loan and interest only.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn102\" name=\"bodyftn102\">102<\/a>]<\/span>&nbsp;This enabled the borrower to keep the property even though the contractual date for repayment had lapsed, providing the loan and interest were repaid.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn103\" name=\"bodyftn103\">103<\/a>]<\/span>&nbsp;Unfortunately it has been criticised&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn104\" name=\"bodyftn104\">104<\/a>]<\/span>&nbsp;that the equitable duties of mortgagees have been fused with the common law duty of care&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn105\" name=\"bodyftn105\">105<\/a>]<\/span>&nbsp;but this fallacy was put to bed&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn106\" name=\"bodyftn106\">106<\/a>]<\/span>&nbsp;and reiterated&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn107\" name=\"bodyftn107\">107<\/a>]<\/span>&nbsp;extinguishing this fusion argument.<\/p>\n<p>Another area of controversy is that equity will not perfect an imperfect gift,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn108\" name=\"bodyftn108\">108<\/a>]<\/span>&nbsp;nor will it come to the aid of a volunteer;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn109\" name=\"bodyftn109\">109<\/a>]<\/span>&nbsp;unless the donor does everything in their power to complete the transfer.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn110\" name=\"bodyftn110\">110<\/a>]<\/span>&nbsp;There are other exceptions&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn111\" name=\"bodyftn111\">111<\/a>]<\/span>&nbsp;but the controversy arose where a gift was rendered perfect, contradicting the Re: Rose&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn112\" name=\"bodyftn112\">112<\/a>]<\/span>&nbsp;exception&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn113\" name=\"bodyftn113\">113<\/a>]<\/span>&nbsp;based on the fact that; \u201calthough equity would not assist a volunteer,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn114\" name=\"bodyftn114\">114<\/a>]<\/span>&nbsp;it would not strive to officiously defeat it&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn115\" name=\"bodyftn115\">115<\/a>]<\/span>&nbsp;because, it is \u201cbetter viewed as a complete gift without waiting for registration of the transfer.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn116\" name=\"bodyftn116\">116<\/a>]<\/span>&nbsp;It can be argued that these decisions illustrate the courts have departed from the said equitable principles;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn117\" name=\"bodyftn117\">117<\/a>]<\/span>&nbsp;but in hindsight it is just another exception to the rule \u201cthat equity will not assist a volunteer, unless it is unconscionable not to do so.&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn118\" name=\"bodyftn118\">118<\/a>]<\/span>&nbsp;Realistically, equity has veneered an alternative method to fulfil its purpose.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn119\" name=\"bodyftn119\">119<\/a>]<\/span>&nbsp;This concurs that equity is \u201cnot past the age of childbearing;&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn120\" name=\"bodyftn120\">120<\/a>]<\/span>&nbsp;and can create new concepts in law&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn121\" name=\"bodyftn121\">121<\/a>]<\/span>&nbsp;or resurrect old ones,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn122\" name=\"bodyftn122\">122<\/a>]<\/span>&nbsp;further supporting the anti-fusion argument.<\/p>\n<p>As previously mentioned,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn123\" name=\"bodyftn123\">123<\/a>]<\/span>&nbsp;most theories for fusion derive from academics&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn124\" name=\"bodyftn124\">124<\/a>]<\/span>&nbsp;\u201cwho call on lawyers to take fusion seriously&#8221;.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn125\" name=\"bodyftn125\">125<\/a>]<\/span>&nbsp;The jurisdiction of New Zealand are of the opinion that equity and common law are merged, believing \u201cthe law imposes a duty to provide a full range of remedies as appropriate, no matter whether they originated in common law, equity or statute.\u201c&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn126\" name=\"bodyftn126\">126<\/a>]<\/span>&nbsp;Even, \u201cAustralia\u2019s judicial legal historian&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn127\" name=\"bodyftn127\">127<\/a>]<\/span>&nbsp;is of the opinion that the law is now a single composite body;&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn128\" name=\"bodyftn128\">128<\/a>]<\/span>&nbsp;but the majority view of judges in Harris&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn129\" name=\"bodyftn129\">129<\/a>]<\/span>&nbsp;believe \u201cit may take time before the waters of two confluent streams are thoroughly intermixed; therefore equity remains a distinct form of authority&#8221;.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn130\" name=\"bodyftn130\">130<\/a>]<\/span>&nbsp;The fusion fallacy also stems from judges integrating the use of remedies&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn131\" name=\"bodyftn131\">131<\/a>]<\/span>&nbsp;to ensure justice is done.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn132\" name=\"bodyftn132\">132<\/a>]<\/span>&nbsp;There is no doubt that both law and equity work side by side and even complement one another&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn133\" name=\"bodyftn133\">133<\/a>]<\/span>&nbsp;but they remain separate entities.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn134\" name=\"bodyftn134\">134<\/a>]<\/span><\/p>\n<p>The separate divisions of the High Court reiterate that law and equity remain separate entities. The Chancery deals primarily with matters involving equitable rights and remedies, whereas the Queen\u2019s Bench deals primarily with matters involving rights and remedies at common law;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn135\" name=\"bodyftn135\">135<\/a>]<\/span>&nbsp;ratifying the Judicature Act,&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn136\" name=\"bodyftn136\">136<\/a>]<\/span>&nbsp;which was intended to \u201cachieve procedural improvements in the administration of the law and equity, not to transform equitable interests into legal titles or to sweep away the rules of common law.&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn137\" name=\"bodyftn137\">137<\/a>]<\/span>&nbsp;The equitable defence of \u201cLaches&#8221;&nbsp;<span class=\"essay_footnotecitation\">[<a class=\"essay_footnotecitation_link\" href=\"#ftn138\" name=\"bodyftn138\">138<\/a>]<\/span>&nbsp;is another pivotal example of anti-fusion. Prior to any proceedings, the courts will ascertain when the breached occurred.
